Can the nursing home sell everything I own?
No they can't. However, I have heard of nursing homes telling residents that very thing; including selling their home! That is just not true. Under Michigan law, you are allowed to keep your home (there is an equity limity - see the "Can I keep my home?" question in this section) , 1 vehicle, all of your household and personal goods. You can also have a prepaid funeral and burial plots and keep certain life insurance policies.
Everything else is counted towards your $2,000 asset limit. This includes bank accounts, CD's, IRAs, 401(k)s, investment accounts, etc. For a married couple, the spouse is allowed to keep one-half of the couples assets up to $126,420. However, there a legal planning options available to protect these assets.
